US porn studio Vivid Entertainment threatens to sue HTC

Vivid Entertainment is threatening HTC with legal action over the name of its new smartphone, HTC Livid.
 
The porn giant, which famously produced the Paris Hilton and Kim Kardashian sex tapes, has sent HTC America a cease and desist letter claiming the mobile phone giant’s latest model infringes on its trademark.
 
It is threatening to sue HTC if it fails to change the name of its new handset by Monday.

The US-based adult entertainment company claims it is looking to protect its brand’s identity and is concerned that users may believe the two businesses are somehow connected.
 
Vivid Entertainment’s attorney Mark Hoffman said in a statement that HTC America’s use of the Vivid trademark “creates the false impression" that HTC and its products are "affiliated, connected, or associated with and or sanctioned by Vivid Entertainment.”
 
The company’s Founder/Co-Chairman, Steven Hirsch, added: “For the past 27 years Vivid has worked hard to protect and build its brand. We believe this is a clear infringement and will use all legal remedies available to protect our trademark.”
 
HTC has refused to comment on the matter at present.
